Terms of Service

Acceptance of terms

By accessing or using Texas Settlement Calculator (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

What this site is

Texas Settlement Calculator is a free, Texas-focused online tool that generates a preliminary, non-binding estimate of a personal injury claim's potential value based on the information you provide. The Site is not a law firm and does not provide legal advice or legal services. Nothing on this Site creates an attorney-client relationship between you and Texas Settlement Calculator or any attorney.

No legal advice

All estimates generated by the Site are informational only and are not legal advice. The actual value of any personal injury claim depends on facts, evidence, and legal analysis that this tool cannot fully evaluate. A licensed Texas attorney can provide legal advice about your specific situation. The choice of a lawyer is an important decision and should not be based solely on advertisements.

Attorney advertising

This Site may constitute attorney advertising material in some jurisdictions. Prior results do not guarantee a similar outcome. The Site facilitates connections between consumers and Texas-licensed attorneys and law firms. Submitting an evaluation or requesting contact does not create an attorney-client relationship, which is formed only by a signed engagement agreement between you and the attorney.

Compliance with Texas legal rules & comparative fault

Modified Comparative Fault (51% Bar Rule): Under Chapter 33 of the Texas Civil Practice and Remedies Code, a claimant's financial recovery is reduced by their percentage of responsibility and is completely barred if their share of fault exceeds 50%. Calculations provided on this Site are illustrative and cannot assess legal fault, which is determined solely by triers of fact or formal negotiations.

Paid vs. Incurred Expenses: Pursuant to Section 41.0105 of the Texas Civil Practice and Remedies Code, recovery of medical or healthcare expenses in Texas is limited to amounts actually paid or incurred by or on behalf of the claimant. User input reflecting unadjusted billing amounts may distort calculation outputs.

Statute of Limitations Notice: Under Section 16.003 of the Texas Civil Practice and Remedies Code, most personal injury claims in Texas are subject to a strict limitations period that commonly begins at two years from accrual for many personal-injury claims, but exceptions, tolling, notice requirements, parties and claim type can alter the analysis. Consider consulting a licensed Texas lawyer about preserving your rights.

Attorney advertising & consumer-contact disclosure

Attorney Advertising and Consumer Contact: Texas Settlement Calculator is an independent online tool and Internet-based attorney-advertising platform; it is not a law firm. The platform does not recommend or endorse a participating attorney or represent that an attorney was selected after an analysis of the consumer's legal problem.

Consumer-Requested Attorney Contact: If you opt to submit your contact information or personal injury details to request attorney contact, you explicitly consent to having your information transmitted only to the specific verified paid participating advertiser displayed to you when you affirmatively request that firm's contact. TSC does not hold an unassigned request for later transfer to a newly participating firm and does not substitute another firm if the displayed advertiser becomes unavailable. Participating lawyers or law firms may pay the Site operator a flat subscription fee for advertising placement and eligibility to receive consumer-requested inquiries within a defined territory. The fee is not based on a particular inquiry, signed client, legal fee, settlement, or recovery. Receiving a contact attempt or case review from a participating attorney does not constitute an agreement by that attorney to represent you.

No Guarantees or Endorsements: The Site does not endorse, recommend, or guarantee the qualifications, competency, or legal results of any third-party attorney or law firm you affirmatively request to contact you through the Site.

Optional contact consent

Requesting attorney contact is optional and is not a condition of using the calculator or purchasing any goods or services. When you check the separate consent box, you authorize contact only about the request you submitted from the specific verified paid participating advertiser identified to you before consent. TSC will not substitute another firm if that advertiser becomes unavailable. You may revoke that permission at any time through any reasonable method, including replying STOP to a text, telling the caller, emailing privacy@texassettlementcalculator.com, or using the Site's privacy and contact-preferences portal.

Accuracy of estimates

The Site provides broad educational preliminary ranges, not legal valuations or predictions. We make no representation or warranty that any range is accurate, complete, or predictive of an actual settlement, verdict, or net recovery. Results are based on generalized rules and the information you provide, which may be incomplete, unverified, or inaccurate. You use the Site and any estimate at your own risk.

Your responsibilities

You agree to provide truthful and accurate information when using the Site. You agree not to misuse the Site, including attempting to access unauthorized areas, introducing malicious code, scraping or automated data collection, or interfering with the Site's operation. We may suspend or terminate access for any violation of these Terms.

You may not copy, reproduce, or distribute Site content without permission, except as permitted by fair use or other applicable law.

Limitation of liability

To the fullest extent permitted by law, Texas Settlement Calculator and its operators shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of, or reliance on, the Site or any estimate it generates, even if advised of the possibility of such damages.

Indemnification
